Green Card Renewal Process

While resident status itself does not expire , green cards ( official documentation of permanent resident status) to be renewed every 10 years. Neglecting to renew Green Card can be difficult to travel abroad or to prove your eligibility for employment in the U.S.

Residents renew their green cards every 10 years using the Form I- 90 application Replace Permanent Resident Card . Form I- 90 can be used to replace the unexpired Green Card.


 When you apply for green card renewal ( Form I- 90 ) is fed ?

Within six months of the expiration date listed on the Green Card
Form I- 90 can not be filed more than six months earlier.
If your Green Card has expired , you need to file a Form I- 90 immediately
If you have an older version of the Green Card with no expiration date on the USCIS
Strongly recommends that you apply for a replacement Form I- 90
 
Replacing your Green Card using Form I- 90

In addition to renewals , Form I- 90 can be used to replace the current green card in the following situations:
 
Your card is lost or stolen
Your card was mutilated or destroyed
Your card has an error in it ( as a spelling error)
Your card never received
Your name has changed
 If you became a permanent resident before you are 14 years old, you are required
To replace the card after 14th birthday
 
What if I'm Conditional permanent resident ?
Conditional permanent residents are given a green card that is valid for two years. Form I- 90 should not be used for renewal of a conditional permanent resident status .

Within 90 days of a two-year shelf life, Conditional permanent residents are required to file a petition for " removal of conditions " from their Green Card . If conditional status based on marriage , you must submit Form I- 751 , Petition to remove residence conditions . If conditional status as an investor , you must submit Form I- 829 , Petition by Entrepreneur to Remove Conditions on Permanent Resident .

Once your petition is approved, you will get a new green card valid for 10 years. After this time , a typical process renewal ( including Form I- 90 ) must be used .

Green composition for card renewal

Applications for Green Card renewal may be denied for various reasons . Two of the most common reasons would be criminal activity and adjustment of immigrant category.

Criminal activity means that you committed a crime , and therefore no longer be regarded as a valuable asset to American society. However, this is really only applicable to larger crimes such as crimes. Minor offenses such as speeding tickets probably will not lead to the refusal of an application for Green card renewal .
 
Correction of immigrant category means that your circumstance has changed in such a way that the reason why they were granted a green card is no longer applicable . For example , if they have a green card through marriage to a U.S. citizen , but has since gotten divorced, your application for a green card can not be denied .

If your application for renewal has been denied , you have the opportunity to ask USCIS to reconsider its decision. You may submit a motion to reopen or a motion for revision of the same service to deny your application. This will lead to USCIS to review your case and reconsider their decision .
 
In the motion to reopen , be sure to clearly identify and provide evidence as to why your application was wrongly denied and why USCIS should review .


Green Card INA 
All modern U.S. immigration law is made ​​under the Immigration and Nationality Act (INA). Section 264 of the INA is for green cards. It reads as follows:

" Any alien in the United States ... shall be issued a certificate of alien registration or alien registration card in such form and manner and at the moment are determined under regulations .... "

This means that any immigrant in the United States gives the green card. The INA also read:

"Every alien , eighteen years of age and over , shall at all times carry with him and have in his personal possession any certificate of alien registration card or alien registration issued to him .... Any alien who fails to comply with [ these provisions] shall be guilty of an offense ... "

This means that if you are an immigrant , you should always carry your green card with you.
