VISA PROJECTIONS

The U.S. Department of State has issued the Visa Bulletin for January 2010. Although there is very little movement forward this month, the Department of State has issued some projections for the future.

Not surprisingly, the Department of State said some it is unlikely there will be any cut-offs in the First
Preference Categories. China and India in the second preference category have the potential to become unavailable due to heavy demand.
The Department of State issued the following projections for movement during Fiscal Year 2010 (which ends September 30, 2010):

Second Preference Category:

China: should process through October 2005 cases

India: should process early March 2005 cases

Third Preference Category:

Worldwide category: should process through August 2005 cases

China: should process through September 2003 cases

India: should process through February 2002 cases

Mexico: should process through June 2004 cases

Philippines: should process through August 2005 cases

This does not take into account cases that may be withdrawn or denied, which would create further movement for cases that remain in the pipeline.

These projections from the Department of State are based upon a combination of statistics that have been made available in the last few months, such as cases pending at the Department of Labor, cases pending at USCIS with approved I-140's, and I-485 cases pending at USCIS.

These projections are very much consistent with what Hammond Law Group predicted at the Healthcare Symposium in early November. Hammond Law Group continues to believe the movement for third preference category from the Philippines will begin to see steady movement.

H-1B Cap for FY2010 Has Been Reached USA,H-1C Nonimmigrant Visa Category Ends on Dec. 21, 2009 USA

H-1B Cap for FY2010 Has Been Reached

U.S. Citizenship and Immigration Services (USCIS) has announced that, as of December 21, 2009, it has received sufficient H-1B petitions to reach the statutory cap for FY2010. USCIS has also received more than 20,000 H-1B petitions on behalf of persons exempt from the cap under the advanced degree exemption. USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on December 21, 2009.

USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2010 that are received after December 21, 2009

H-1C Nonimmigrant Visa Category Ends on Dec. 21, 2009

U.S. Citizenship and Immigration Services (USCIS) reminds the public that the H-1C non immigrant category expires on Dec. 21, 2009.

The H-1C non immigrant temporary worker classification authorizes the admission of up to 500 nurses annually to work in eligible health care facilities. After the original 1999 statutory authorization of the program expired in 2005, Congress reauthorized it for three years beginning Dec. 20, 2006 in the Nursing Relief for Disadvantaged Areas Reauthorization Act of 2005. The statutory authority for the program has not been extended. USCIS will accept petitions until Monday, Dec. 21, 2009

This expiration does not affect the ability of H-1C nurses currently in status to continue employment during their authorized period of stay, the authority of USCIS to adjudicate a petition properly filed on or before Dec. 21, 2009, or the eligibility of the beneficiary of an approved H-1C petition to be admitted to the United States as an H-1C non immigrant.

Israel to Freeze Jewish Immigration

In an emergency cabinet meeting, Prime Minister Benjamin Netanyahu announced today that in order to create the necessary positive atmosphere to restart peace negotiations with the Palestinians, all Jewish Immigration to Israel, "aliya," would be frozen immediately for a temporary period of 10 months.

Netanyahu explained that increased Jewish demographics in Israel via immigration, creating "facts on the ground" would cause mistrust between the Palestinians and Israel and "would not be helpful" in progressing the peace talks.

Israeli government ministers overwhelmingly approved (11-2) the temporary freeze in an effort to restart peace talks with the Palestinians.

Israeli Prime Minister Benjamin Netanyahu called the freeze "far-reaching and painful," yet the move would be "a very big step toward peace" and he hoped the Palestinians would "take full advantage" of the opportunity to restart talks during the 10-month window.

At least one key Security Cabinet member, Defense Minister Ehud Barak, came out in favor of the proposal. "Its aim is to open a window for renewing negotiations with the Palestinians," he said.

"I hope that the Nefesh B'Nefesh immigration leadership, which is patriotic, responsible and serious, will understand the need for the decision at this time," Barak added.

"The understandings with the United States are of the utmost importance with regard to negotiations, and guarantees of security and its military supremacy."

The Nefesh B'Nefesh aliya/immigration organization was puzzled over the move. "Classical Zionism always included immigration of Jews to Israel and its our historic right to continue to move to Israel," stated a hastily compiled Nefesh B"Nefesh press-release.

MK and Minister Benny Beigin called the move, "painful but correct", and that after the 10 month immigration freeze, immigration would again resume.

Deputy Foreign Minister Danny Ayalon praised the "historic" decision, and urged the Palestinian Authority to seize the opportunity for peace.
"We hope the Arabs will not repeat the miscalculation of November 29, 1947, and will not miss the opportunity to achieve peace. Netanyahu's decision to freeze immigration is historic and unprecedented," Ayalon said during a discussion at the Hebrew University in Jerusalem.
But Danny Danon, a member of the Knesset from Netanyahu's Likud Party and chairman of the Settlers Council, opposed the announcement. "If the prime minister will implement the ideology of the left, he will not get the support of his own party," he said.

"All the things he wrote in his books, said in his speeches, he so eloquently preached for, he does exactly the opposite," said Danon, calling the move a "disappointment."

Foreign Ministry Director-General Yossi Gal summoned foreign ambassadors in Israel to a meeting in Jerusalem Monday. Gal is expected to brief the ambassadors regarding the cabinet's decision to freeze Jewish immigration for 10 months.

"We must work to achieve understanding and declarations of support for the Israeli move," the Foreign Ministry missive said.

French Foreign Minister Bernard Kouchner said in a statement the Israeli move was a "step in the right direction" and "a positive contribution to peace."

British Foreign Secretary David Miliband said his country wanted the Israeli decision to "become a step towards resuming meaningful negotiations."

He called on Israel to implement a full freeze on immigration, which he deemed "illegal."

Defense Minister Ehud Barak said Monday that he believed Israel's declaration of a 10-month freeze on Jewish immigration would lead to a renewal of peace talks with the Palestinians.

MK Michael Ben-Ari [National Union] slammed the decision, calling it yet another nail in the coffin of Zionism. "First the disengagement from Gaza, then the construction freeze, and now the immigration freeze -- is there nothing left of Zionism?"

The Obama administration welcomed the decision Wednesday as a step toward resuming Israeli-Palestinian peace talks, Secretary of State Hillary Clinton said in a statement released moments after Netanyahu announced the 10-month freeze.

457 WORK VISA TO AUSTRALIA,WORK VISA TO AUSTRLIA,AUSTRALIA WORK VISA

A review of the 457 Temporary work visa program means that skilled overseas workers will now be entitled to the same pay as their Australian counterparts. This change comes into effect on January 2010, and according to the Minister for Immigration and Citizenship, Chris Evans, it serves two purposes.
"It ensures overseas workers are not brought in more cheaply to undercut Australian workers and their conditions" said Senator Evans.
"Secondly it ensures that Australian workers aren't disadvantaged because overseas workers will now be more expensive and preference will go to Australian workers.

Other changes to the 457 work visa program will enable businesses to gain faster access to overseas skilled workers by speeding up the application process for the 457 sponsored work visa. 280 illegal immigrants in California arrested by Immigration and Customs Enforcement, Arrested illegal immigrants in usa

Immigration agents arrested 280 people in California in their biggest push yet to round up suspected illegal immigrants with criminal records in local communities, authorities said Friday.

More than 400 agents and local law enforcement officers fanned out across the state in the three-day search led by Immigration and Customs Enforcement.

illegal immigrants in California

"These are not people who we want walking our streets," ICE director John Morton said. "We're going to focus on those people who choose to pursue a life of crime in the United States rather than pursue the American dream of education, hard work and success."

The operation came four months after Morton said the agency's fugitive operations teams would increasingly focus on finding people with criminal records and would no longer use arrest quotas.

The teams arrested twice as many immigrants with criminal records in the 2009 fiscal year than during the year-earlier period, according to agency statistics.

On Wednesday, agents wearing hooded sweat shirts and jackets emblazoned with "ICE" clustered outside a row of apartment homes inHuntington Park in the morning cold to look for a gang member who was deported to Mexico in 2007 after serving time for vehicle theft.

Agents had learned his wife was here and collecting food stamps, leading them to believe he had returned to this country illegally.

Slinging rifles across their backs, they approached the front gate. One rapped on a window and said "Police!"

Minutes later, they emerged with a 40-year old man known as "Rascal" in handcuffs and drove him to Los Angeles to be fingerprinted, photographed and detained.

"As we bring these people into custody, we're also contributing to the reduction of crime in our local communities. That's really the thrust of it all," said Robert Naranjo, an assistant field office director for ICE's detention and removal operations in Los Angeles.

The man declined to be interviewed. ICE would not release his name because he did not face new criminal charges as of Friday but expected he would be charged next week with illegally re-entering the country, said agency spokeswoman Virginia Kice.

More than 80 percent of the people arrested this week had prior convictions for serious or violent crimes, according to ICE. Seventeen people will face federal charges for re-entering the country illegally after being deported.

The arrests carried out from Tuesday to Thursday were similar to those made in prior years by fugitive operations teams, which were created in 2003 to help reduce the number of immigrants who failed to obey deportation orders.

The latest sweep also netted six people who had deportation orders but no criminal record. No arrests were made of people who did not have a criminal history or a court order to leave the country, Kice said.

That marked a shift from several years ago, when immigrant advocates complained that ICE's teams were arresting illegal immigrants who happened to be home when authorities knocked on the door looking for someone else.

"It is tough to fully believe what is happening, but it certainly is a major step," said Jorge-Mario Cabrera, a spokesman for the Coalition for Humane Immigrant Rights of Los Angeles.

In a memo dated Tuesday, Morton said the teams' core mission is to arrest people with final deportation orders, including those with criminal records.

A copy of the guidelines obtained by The Associated Press directs teams to focus at least 70 percent of resources on these immigrants, followed by those who have re-entered the country illegally or who have committed crimes.

The memo also said agents will be trained twice a year on the Fourth Amendment, which protects people from unreasonable search and seizures, and should not arrest immigrants who are sick, disabled or the sole caretakers of children.

There are 104 fugitive operations teams across the country. In 2006, each team was assigned to make 1,000 arrests a year. In August, Morton — who took over his post this year — said he had done away with the quotas. Associated Press Writers Eileen Sullivan and Suzanne Gamboa contributed to this report from Washington.

Immigration Processing for Typhon Victims Canada

Immigration measures brought in to help victims of Typhoon Ketsana in the Philippines has led to priority processing for over 400 applications from close family members of Canadian citizens and permanent residents. On 26 September 2009 Typhoon Ketsana struck Manila the capital of the Philippines and other areas of the Northern Philippines which resulted in the worst flooding in this area for over 40 years.

Immigration Processing for Typhon victims canada

"Immediately after that happened, on behalf of our government, I announced that special measures would be in place to expedite immigration processing for typhoon victims," said Immigration Minister Kenney. "We wanted to help reunite victims with close family inCanada. I am happy to report that our government kept its promise."

During the period 1 October 2009 to 29 November 2009 a number of new and existing immigration applications were expedited. On 27 November 2009 there were over 420 applications that qualified for priority processing. Temporary residence applications were also accepted for priority processing from people who had been badly affected by the typhoon.

Recently, there has been a considerable reduction in the number of applications from the regions affected by Typhoon Ketsana. The Canadian Government feels that it is therefore unnecessary to continue with the special measures.

From 1 October to 29 November, 2009, CIC expedited the processing of new and existing applications from close family members of Canadian citizens, permanent residents and protected persons. As of 27 November 27, 2009 over 420 applications qualified for priority processing. Each application may include more than one family member. Applications for temporary residence from people significantly affected by the typhoon were also accepted for priority processing.

Now that applications from those originally affected by Typhoon Ketsana have declined significantly, the Canadian Government decided to end the special measures to expedite processing of immigration applications. Any applications received up to November 29th have been reviewed to see if priority processing applies. Most of the applications from those affected by the typhoon came from parents and grandparents who have family members in Canada.

"Canada has a proud tradition of helping Canadian citizens and permanent residents reunite with their family members abroad when natural disasters occur," said the Immigration Minister.

How To Get a Job in Canada, Job in Canada

How To Get a Job in Canada :

Canada welcomes new migrants with valuable skills and qualifications, however searching for employment will be a challenge. It is important to be realistic and understand that you may not be able to find your ‘dream job’ straight away.

How To Get a Job in Canada
Does and Don'ts

It is never easy searching for a job from overseas. Here is a summary of the do’s and don’t for overseas jobseekers in the Canadian employment market place.

Do

Do visit the various Canadian job websites BEFORE deciding to emigrate to familiarise yourself with the job opportunities in your field.

Do apply for your permanent residence visas. Very important. Prospective employers will ask about your immigration status and having your residence visas (or at least being in the application process) is a prerequisite for most Canada job vacancies.

Do start applying for advertised vacancies from OVERSEAS, but only 1 to 12 weeks before a possible start date or a visit to Canada.

Do send a "cold" letter of application and C.V. to EVERY potential employer and recruitment agent in the region of Canada you intend settling in to let them know that you are available. Use www.yellowpages.ca to locate details.

Do prepare your C.V. in the Canadian style and write a short but clear covering letter confirming that you have been granted permanent residence visas (or that you have been assessed as eligible and are in the visa application process).

Do provide a Canadian postal address and Canadian mobile/email address in your C.V. where possible.

Do visit Canada or arrive permanently (once your visas have been approved) to attend job interviews, as very few employers will engage candidates on a “sight unseen” basis.

Do make a positive impression in the interview, be flexible and have copies of your residence visas and references available for employers to sight.

Don't

Don’t apply for job vacancies OR visit Canada for job interviews more than 1 - 12 weeks away from a possible start date. Employers will not be interested.

Don’t expect everything to work like home. Be flexible and willing to fit in with local ways of doing things.

Don’t expect a job at the same level or higher than you had overseas. You may lack Canadian local knowledge and may need to take a step back in order to advance later. Wait one year.

Don’t expect the same salary or more than you had overseas. The cost of living and income tax rates are lower in Canada than many other western developed nations, so look at your NET INCOME not the gross amount.

Don’t expect a job offer in the first week. On average, it can take native Canadians 1 – 8 weeks to find a new job.

Don’t “over negotiate” the contract with your first employer. Be flexible and under-stand that employment law and contract terms may be different in Canada.

How To Prepare Your Resume (CV)

How To Prepare Your Resume (CV)

Before you start the job search process it is essential that you prepare a professional resume (CV) fitting the local Canadian style. Generally a resume that is styled for the UK, European or other overseas markets will not be suitable for use in Canada. Your resume should provide a description of your skills and competencies, your educational and work history, and your achievements. It may be formatted as follows:

Personal Details
  • Name
  • Address (Where possible, please use a reliable address in Canada if you have friends or family in the country.)
  • Phone and E-mail address
  • Date of Birth
  • Nationality (IMPORTANT - clearly state that you are applying for Canadian permanent residence visas or are approved.)
  • Career Goals: Summarise your careere objectives
  • Profile Summary: A brief summary of your personal attributes, key skills, competencies and technical capabilities including software packages used, etc

Top 10 Migration Issues of 2009, Migration issues of 2009

Unlike labor migrants in most parts of the world, the Eastern Europeans in Ireland and the United Kingdom have been going home in large numbers knowing that returning to Dublin or London when conditions improve is as simple as booking a flight.

In Ireland, where the unemployment rate hit 12.0 percent in the second quarter (Q2) of 2009, there were 25 percent fewer nationals from new EU Member States employed in Q2 2009 compared to Q2 2008. At the same time, the number of Eastern Europeans in Ireland who were unemployed more than doubled, from 12,000 to 29,100. While non-Irish nationals made up 15.8 percent of Ireland's labor force in Q2 2008, a year later they accounted for only 14.2 percent.

Data on employment level by nationality show that the number of A8 nationals working in the United Kingdom dropped from 503,000 to 483,000 (or 4.0 percent) between July-September 2008 and July-September 2009.

Over the same period, the employment level for UK citizens went down 1.6 percent and the level for all non-UK nationals decreased 2.0 percent. The total unemployment rate in the United Kingdom as of July-September 2009 was 7.8 percent.

According to provisional 2008 data from the UK International Passenger Survey, emigration among A8 citizens began rising in early 2008, from 32,000 for the year ended March 2008 to 66,000 for the year ended December 2008.

Immigration of A8 citizens reached an all-time high in the year ended December 2007, at 109,000. But immigration dropped to 79,000 for the year ended December 2008. For A8 nationals, net migration in December 2009 was at its lowest point since the A8 joined the European Union.

UK national insurance number (NINO) data provide additional evidence that fewer Eastern Europeans are arriving (any non-UK citizen looking to work or claim benefits/tax credits in the country must have a NINO). The number of NINOs issued to citizens from the new EU Member States dropped 23 percent from their peak of 332,440 in 2007-2008 to 257,040 in 2008-2009. But the decrease for Polish nationals was 36 percent over the same period, from 210,660 to 134,360.

Remittances :

When migrants lose their jobs, they have less money to survive on and to send home. In terms of remittances, the $338 billion total for 2008 came in above World Bank expectations, for the most part due to very large increases of remittances to India ($14.4 billion more than in 2007) and China (+$9.7 billion), as well as Bangladesh (+$2.4 billion) and the Philippines (+$2.3 billion).

In the case of India, the increase was mostly due to currency exchange fluctuations and extremely favorable conditions for purchasing real estate.

The World Bank projected in November that remittances will drop 6 percent to $317 billion for 2009, largely because of the recession.

According to Migration Policy Institute analysis of Central Bank data, the countries that have experienced the steepest declines between 2007-2008 and 2008-2009 are Turkey, Moldova, Poland, Ecuador, Morocco, Mexico, and Kenya. In contrast, remittances to South Asia have risen, not surprising given India's substantial increase in 2008. Also, many South Asian migrants work in the gulf countries, where the recession has not been as severe.

With 31 percent of Moldova's GDP coming from remittances, the decrease there is far more significant than the one in Turkey, where remittances are just 0.2 percent of national income. Ecuador has suffered because its migrants are concentrated in recession-battered Spain and the United States.

The World Bank reported that remittances to Mexico declined 13.4 percent for the first nine months of 2009 compared to a year earlier but noted that the downward trend for all of Latin America appears to be bottoming out.

Since many economists are predicting a jobless global recovery, immigrants will probably not be much better off in 2010 than they were in 2009.

Students On Immigration Fast Track Canada

Canada has finally joined countries such as England and Australia in creating a program that will allow international students to work up three years after graduation. The Canadian Post-Graduation Work Permit Program has attracted a wave of applications, as it should, because it now opens up the possibility of fast-tracking immigration for international students.

Previously, international students were allowed to work on campus, however, employers were very hesitant to hire students for co-op programs because of lack of future availability for possible permanent positions.
Lise Pedersen, an international student adviser at Wilfred Laurier in Waterloo, Ontario commented that the program will increase employment opportunities for students during and after graduation. Jennifer Humphries, Bureau VP, stated that, "People are looking at the potential for career advancement for their education. If they have three years of work after graduation, this looks better on their resumes."

Anna Done Choudhury, Pedersen's colleague also stated that, "allowing students to work after graduation for three years will mend the gap between international students and Canada wanting qualified immigrants." Prior to this new program students who wanted to advance their eligibility for permanent residence had to move to the U.S. then return to Canada then apply.

The Canadian Post-Graduation Work Permit Program now takes students who have worked during post graduation out of the immigration points system and decides who passes and who fails. So far, at least 95% has passed which is great news for Canada. According to the 2009 Survey of International Students more than half of all international students plan to remain in Canada after graduation to find work.

This new program will likely see an increase in applications for work permits as well asCanadian citizenship.

Canadian immigration news,Canada ranks as top migration destination

A recent HSBC poll of expatriates in 50 countries put Canada as the top country in the world for quality of life and the best place to migrate

HSBC's David Norton said, "We have seen that there is a distinct trade-off between income and overall quality of life. Many of the top performers in our first report, which examined the best places to make and save money, have scored towards the bottom of this report's league table. What is clear is that the locations where salaries may not be as high, such as Canada and Australia, are where expats are really enjoying not only an increased quality of life but are also finding it easy to fit in to their new communities".

Canadian immigration news

The survey polled 3,100 expats from 50 countries, who gave Canadian immigrationthe highest marks in accommodation quality along with highest quality of life, followed by Australia.

Most expats in Canada are skilled workers who migrated to the country on a Canadian Skilled Worker Visa. Currently, Citizenship and Immigration Canada has a Priority Occupation List, a list of occupations in demand in the country, and potential migrants with occupations on this list are eligible for skilled immigration to Canada without the requirement of having a job offer from a Canadian employer. For example, people with an occupation of plumber, welder, or bricklayer will be able to migrate to Canada as a matter of priority with the potential to arrive within months of beginning the application process.

Jobs in united kingdom,Jobs available for migrant workers

The number of jobs available to foreign workers through the shortage occupation route will be reduced, the Government announced on 11th November.
The shortage occupation list sets out those jobs for which there are not enough resident workers, and will be used as part of the skilled worker tier (Tier 2) of the Australian-style points system, which will be launched on 27 November.

Tier 2 of the points system will ensure that British jobseekers get the first shot at jobs and only those foreign workers we need will be able to come to the United Kingdom.

Recent Government work to ensure British workers are skilled and competitive means that many of the previous gaps in the labour market have been filled. As a result, today's list is tighter than ever before and will see a reduction of more than 200,000 positions in occupations with shortages that need be filled by migrant workers.

The number of positions available to migrants has been reduced from one million to just under 800,000, ensuring that only those foreign workers we need - and no more - can come here.

Border and Immigration Minister Phil Woolas said:

"The Australian-style points system is flexible, allowing us to raise or lower the bar according to the needs of business and taking population trends into account.

"Had the points system been in place last year there would have been 12 per cent fewer people coming in to work through the equivalent work permit route. On top of this, the strict new shortage list means 200,000 fewer jobs are available via the shortage occupation route."

Under Tier 2 companies must pass the Resident Labour Market test by proving they cannot fill the post with a resident worker before they can bring in someone from outside the EEA. If the job is on the shortage list the company will not need to pass the test.

The Government publishes the shortage occupation list following advice from the Migration Advisory Committee (MAC). Their recommended list has been adopted in full - with the addition of social workers, who will remain on the list while further evidence is considered by the MAC.

Further Education Minister Sion Simon said:

"This Government is making an unprecedented investment in skills and training to ensure that United Kingdom residents do not lose out to overseas workers or see jobs go abroad because of a lack of skills.

"We have recently made a number of funding deals with employers, worth £630 million over three years, to give them greater access to flexible, bespoke training aimed at tackling skills shortages in their sectors.

"The deals cover sectors such as catering, hospitality and construction."

To get in under Tier 2 skilled foreign workers must have:

English language skills;
prospective earnings of more than £24,000, or slightly less if they have a decent qualification - or an offer of a job on the shortage list;
enough money to support themselves for the first month of their stay.
Employers will need to get a sponsor licence to enable them to bring migrant workers into the country from outside the European Economic Area. They will be checked out by the UK Border Agency and will sign up to certain duties. This means that Government will share the responsibility for migrant workers with those who benefit from them. The Home Office last week helped businesses to prepare for the changes by publishing detailed guidance on Tiers 2 and 5 (skilled workers and temporary workers respectively) of the system.

The tough points system is just one part of the biggest shake up to immigration and border security in 45 years, along with the fingerprinting of anyone travelling to the UK on a visa and compulsory ID cards for foreign nationals.

Changes to British Nationality Law from January 2010,British nationality change january 2010

The UK Border Agency in August 2009 announced changes to British Nationality Law under the Borders, Citizenship and Immigration Act 2009. Some of these changes will take place in January 2010.

The most significant change will be the introduction of "earned citizenship"; This will not come into force until the Summer of 2011. From January 2010 changes will take place which will make it easier for people in a limited number of cases to gain UK citizenship:

Children born to those in the British Armed Forces who would not otherwise qualify for UK Citizenship may be registered. Children born in the UK to a parent who then joins the Armed Forces can also be registered.
Children born outside the UK to British parents who were also born outside the UK, but who have a grandparent born in the UK can currently be registered as British within twelve months of the child's birth. This period will be extended so that the child can be registered at any time before the age of eighteen years.
British Nationals Overseas (people with a connection to Hong Kong) who have not after 19 March 2009, given up or lost an alternative nationality by his or her own action or failure to act may be registered as British Citizens.

Those born overseas to British mothers before 8 February 1961 who would have acquired British citizenship had their father been British will be able to register as British citizens. It should be noted that in some circumstances the children of unmarried British fathers are still being discriminated against.

It is yet to be decided what the requirements will be for "earned citizenship". Probably there will be a probationary period during which time you will have to show that you will be a "good citizen". If you meet the requirements for UK citizenship it may be worth considering making an application sometime in the next twelve months. If you already have a pending application with the Home Office you will be considered under the current rules. You will not come under the new rules.

If you qualify for indefinite leave to remain you should apply sooner rather than later. Those with indefinite leave to remain have until July 2013 in which to apply for UK citizenship under the existing criteria.
You will also find further details of the changes in our previous report on UK citizenship.

Business Skills Migration(Australia)

If you are a well-qualified and successful business person wishing to move to Australia under the business migration categories, there may very well be an opportunity for you to eventually gain permanent entry to Australia. It is likely that you will be able to apply in a category under which relevant skills, business experience and language ability are needed in order to satisfy Australian immigration requirements to live and work in Australia. If you don't meet these requirements, you may alternatively qualify if you meet skilled migration visa requirements.

Each business migration category has different requirements for entry to Australia. In most cases you will be granted a four-year temporary business visa initially, and then after satisfying evidence of a specific level of business activity or investment, you will be able to apply for permanent residency. A direct permanent residence category will still be available for high-calibre business migrants sponsored by State/Territory governments known as the Business Talent visa. Please select the relevant link from the categories below for more information on the requirements for each visa class:

Business Entry categories :

==>Business Owner - for owners or part-owners of a business
==:Senior Executive - for senior executive employees of major businesses. For Business Owners and Senior Executives, certain obligations must be met and applicants will be monitored on arrival in Australia
==>Investor - for investors/business people willing to make a significant investment in Australia Note: Applicants coming under all of the above categories may also be sponsored by an Australian State/Territory, making the requirements for business entry a bit more lenient, because sponsorship from a State or Territory government allows applicants to be assessed against lower level criteria. State and Territory governments have specific criteria for deciding who they will sponsor and the relevant State/Territory business development agencies should be contacted for information in this regard.
==>Business Talent (permanent residency) - for very high-calibre business people who have sponsorship from an Australian State/Territory government.
==>If you are a UK business opening up a branch or office in Australia, please see our special information on visas for you and/or your employees.

Canadian Government Immigration Plan to boost immigration, canada government plan

On 30 October 2009 Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism, put forward Citizenship and Immigration Canada's 2009 Annual Report.

"While other countries have cut back immigration levels as a short-term response to the global economic downturn, our government is actually maintaining its immigration levels to meet the country's medium - to long - term economic needs," said Minister Kenney.

"Canada plans to welcome between 240,000 and 265,000 new permanent residents in 2010, the same number of immigrants as in recent years. In 2010, Canada will again welcome more new permanent residents than the average annual intake during the 1990s," said Minister Kenney. "The focus of the 2010 plan is on economic immigration to support Canada's economy during and beyond the current economic recovery."
The good news is that the admission range for immigrants nominated by the provinces and territories has been increased. It is felt that provinces and territories are most likely to know most about their labour market needs and, also, that increasing the number of visa under this category will result in immigration benefitting the whole of Canada. Another benefit is that people coming under the provincial nominee programme will mean fewer people having to come under the federal skilled worker program which means increased resources so that skilled worker applications can be dealt with more quickly.

In the last year the Canadian Government has had an action plan that has resulted in faster processing of immigration visas. "People applying now under the federal skilled worker program can expect to receive a decision within six to twelve months, compared to up to six years under the old system," said Minister Kenney. "We've also brought the backlog of federal skilled worker applicants down from over 630,000 to 425,000—a reduction of more than 30%."

There is still a backlog of people waiting for decisions on their applications who applied before 27 February 2008. This is the date that the action plan took effect. Since this date a further 240,000 people have applied under the Canadian skilled worker program. The action plan has been a success and has resulted in twelve percent fewer people waiting for a decision than before. This is including the 240,000 new applicants.

"Before we changed the system, we had to process every application received. Since many more people applied every year than could be accepted, a backlog was created," said Minister Kenney. "Now that we are processing only those applications that meet specified criteria, our Government is making significant progress in reducing the backlog."

"The Government of Canada will continue to work with provinces, territories and stakeholders to make sure immigration meets the needs of communities, employers and families now and in the future," concluded the Minister.

As the employee, you must also pay a fee for this visa. It is more expensive if you are already in Australia. This payment includes all family members in the application. UK Prime Minister speech on UK immigration, speech prime minister on uk immigration

The British Prime Minister the Rt Hon Gordon Brown MP today set out the United Kingdom Government's views on immigration in a speech in west London. The Government describes the UK immigration system as being tough but fair.

This is the first major speech on immigration by the British Prime Minister since February 2008. Mr Brown feels that it is important that, if possible, British rather than migrant workers help to fill skill gaps.
Key sections of Gordon Brown's speech:

Migrants should obey the law, be able to speak English and make a contribution to British society.
Removal of more occupations from the in-demand list. This will make it more difficult for employers to obtain Tier 2 visas. Employers will need to advertise to show that they cannot find workers from the resident labour market to fill the vacancies. Employers already have to do this much of the time.

It is claimed that current measures had reduced the number of positions available for migrant workers by 30,000 and that reducing the in-demand list further will result in fewer migrant workers being able to gain entry to the UK.

There will be a review of student visas to try and prevent students working illegally in the UK. It should be noted that in general students can, anyway, work part-time during term time and full time during their holidays.

Gordon Brown said:

Immigration is not an issue for fringe parties nor a taboo subject - it is a question at the heart of our politics, a question about what it means to be British; about the values we hold dear and the responsibilities we expect of those coming into our country; about how we secure the skills we need to compete in the global economy; about how we preserve and strengthen our communities.'

It has been shown that immigration is good for the UK economy. Skilled workers are still needed in a number of occupations to deal with skills shortages. It should be noted that there is competition around the World for skilled workers. Any immigration system must make it possible for employers to attract the best available talent from around the World.

Student Visa Australia

Student Visa Australia

Student visas Australia :

Tens of thousands of students come to beautiful Australia every year to take advantage of the high-level of education. The process to obtain a visa depends on your country of origin.

Australia has agreements with certain countries - called Gazetted Countries. If you are a national of a Gazetted Country, a visa will be easier to obtain.

Students from Non-Gazetted Countries will normally be required to obtain a "Favourable Genuiness Assessment" (FGA) from the Australian Embassy before applying to the educational institution for acceptance.

You can be granted a student visa only if you wish to undertake a registered course or part of a registered course on a full-time basis.

A registered course is an education or training course offered by an Australian education provider who is registered with the Australian Government to offer courses to overseas students.
